Help needed with insurance problem





Ok here the story, need advice.

Dads cars stolen, Megane 1.9 DCI. Thief took his keys from his jacket at the local sports club. Also stolen was valuables in car such as mobile and golf clubs.

Reported the loss. Nothing found.

Insurance companies for golf clubs and phone etc pay up after about 10 days.

Car insurance company (Tesco) asks for log book and keys, which my dad sends after 5 weeks of the car not being found.

Insurance company says claim has failed because the keys were too easy to get. Dad disputes failed claim stating they have misquoted his statement to the police (which they have the crooks).

Car is found today. Undamaged and in a garage lock up somewhere.

The question is - Who owns the car? What should my dad do? Go get the car? He doesnt have the log book or the keys. As the insurance claim failed does that mean he can go get the car or do the insurance company legally own it?

Any help appreciated.
 


If tesco have not paid out then car is your fathers, they would only be the owner if they had paid out on the claim. If the car has turned up with the clubs then he will have to tell the insurer who paid out for them, they may ask for cash back or take the clubs in as salvage.

If Tesco havent paid up I would guess he is still the legal owner and should ask Tesco for the keys and log book back. Phone Tesco really I spose.
 


I would dispute that the keys were easy to get, if your father was in a sports club and they were in his jacket where else could he put them other than his jacket, that sounds a very poor decision by the claim handler, if that claim was presented to myself by one of my team i would have after checking with the police have settled up
 


Thats because Tesco are w**k.

My Cup is insured with Renault insurance (uk insurance same as tesco). They wrote the car off over 2 weeks ago and has been sold to a local salvage yard. The thing is i am still paying finance on that car and have had no car for 4 weeks now.

As with my car being only 6 months old it is to replaced with new car. but according to my insurance they cannot get one till late september/october.

Told them to pay me out but they are f**king me around and it was not my fault. Going to blow my top tomorrow to see if they can get there heads out of there arse.
 


I had mine wrote off over 8 weeks ago, also with Renault insurance, took them 6 weeks to just assess the damn thing, then 2 weeks of messing me round saying i owe them the negative equity when it turns out I had the gap insurance. The worst insuarnce comapny I ahve ever been with.
 


uh oh. Am making a claim for my nicked Williams from Tesco. Are they likely to feck me around? I still have the keys and that.
