eBay dilemma

I bought an issue of Evo mag of eBay.

Item number 4617320636

I paid for it straight away.

Normally I'm quite careful with eBay but did it all quickly.

Only after I paid I realised he was only offering the digital scans of pages to be emailled.

He hasn't sent them yet.

I emailled him and asked to refund my payment as I no longer wanted the item and it is copyright infringement.

I don't want negative feedback left (that said, I've fulfilled my end thus far) but he could still leave it after refunding. Then again, I'd whack him with it too.

I'm waiting for him to get back to me but dunno whehter I should threaten reporting to ebay.

With +132 and -0 the last thing I want is negative feedback.

Cheeky fecker even wanted £1.00 postage!

I was just going to see if I've got it sat here i could send you but sadly not. TBH though i'd just go through with it and take note as a lesson learned.

True I should have read the description but surely you can't do this osrt of thing. Evo wouldn't be happy nor would eBay.

Am I right thinking this?

file a complaint saying item not received etc...I'm sure that once that's in motion feedback cannot be left either way but I may be wrong.

Yes. But if you're worried about your feedback then you may as well go ahead with the transaction otherwise you will get negative. The ebay feedback system is inherantly flawed, there's no real way around it.

You could report the item to ebay and see if they can do anything about it.

I'll leave it a few days to at least give him a chance to refund the money.

Either way I sense my first negative looming.

He has no negatives though so it may put him off.

Doesn't help with your problem though - you could fight that with eBay and they'd favour you, I'm sure..

Cheers all. Guy refunded the money no problems. I'll hang on to the option of leaving feedback in case he leaves me any bad.
