iPhone 5 Problem.... ALL Deleted Pictures Have Returned

Woke up this morning to all of my deleted pictures back in my photo stream.

Its limiting the library to only 1000 pictures so every time I take one it deletes an the first one. So I've probably lost 800 actual pictures which I would have wanted to keep.

I dont use iCloud so it cant be that and not plugged it in for a couple of weeks.

Not as easy as that.

When ever I delete them the older ones which I would have wanted to keep which have disappeared are not returning.
