What should I do?

Spotted this auction a few weeks back;

Advertised as a clio CUP spoiler.
"Great" I thought, just what I want. (At this point there are no pictures of the item up, but its a silver clio cup spoiler - so I know what it looks like)

A few days later, a picture is added, a picture of a clio with a standard spoiler. I notice this, but im just assuming the seller has just added a picture of a random clio, not really knowing what he's talking about.

The spoiler arrives today, and you guessed it, it's not a cup spoiler - but a standard one.

Also, the spoiler was advertised as "very good condition", which I would also disagree with, there are a few patches of scrapes and scratches, that I doubt will t-cut or buff out.

What should I do, I have since checked the auction again, and in the sellers defense, it does say "exactly as the one in the pic", but at the same time, it also says, "182 spoiler is bigger and different to the standard clio spoilers but IT WILL STILL FIT A STANDARD CLIO" and "RENAULT CLIO CUP REAR SPOILER 172 182 SPORT, FITS ALL"

Send him an email about the scratches.

I wouldn't mention anything about it being the wrong spoiler as you have kind of admitted yourself it's the one he listed and if you then subsequently mention scratches he might just think you're making up excuses to send it back.

The only place it mentions it being a cup spoiler is in the title, nowhere in the description does he mention it so I doubt you could get anywhere with 'misdescribed' claims.

However the condition could be your bargaining point as Griff says. Email him and see what he says.

I doubt you'll get anywhere tbh. His idea of vgc & yours could be totally different.

The other thing is i'd have wanted to see a pic of the actual thing before I put a bid in. I hate people who just nick others pics or use stock ones.
I've gone by peoples descriptions on things before (taken their word basically) any lived to regret it. Never again !!

- I forgot to add, if you'd asked him if it was scratched etc & he said no, you'll have a case. If he said it was scratched or you didn't ask him then you won't have a case
