Bloody typical. I shell out for new tyres, join the cliosport club, get the sticker and keyring........and the summons lands on the doormat. Until I can get to the solicitors next week, do we have any legal experts out there ?

Danny, there is a form where I can object to the Police officers statement being read in court, do I need to provide a reason for the objection ? One option is to admit that I was exceeding the 50mph limit but by how much , who knows?

Also there is a statement of means form, I assume this is if you want to pay the fine at £1 a week for the next trillion years. Ive a good job and feel that filling in this form will adversly affect any fine I receive, am I legally obliged to fill in the form ?

The Police officers statement does not mention any weather conditions, I was under the impression that they had to state this ?

Been looking at the Dwight Yorke case on http://www.pepipoo.comwww.pepipoo.com , the officer has stated that the device was tested before and after, wondering if theyre wise to the production of calibration certificate.

I could shell out on legal fees, go to court and just wonder what the chances are of getting off ?

Any help, greatly appreciated.

The alleged offence is 87mph in a 50mph zone. The 2 picture provided are grainy shots from behind and give no indication of who was driving!

If you have been caught then you may as well pay the fine, it doesnt matter whos car it is as your the registered owner and therefore are liable to any fines to that car (unless you can prove otherwise).

Road conditions etc may be taken into account but the fact is that your doing nearly 80% more speed in that speed limit, if your lucky you may get off with 6 points and a fine, if you try to fight it and come off worse then your looking at more than 6 points and a bigger fine in most cases.

Tony, thanks for your opinion.

On the day in question the car was dropped off at the Renault dealership, it is concievable that if the accuracy of the time is suspect that one of the mechanics were driving.

No, its the prosecution who have to prove you were driving the car, although if you try this route and fail (because you actually were driving the car) then youll land yourself in a whole load of sh*te.

I could always claim to be half of a Geordie duo doing 127 down the A1 and get a £350 fine and a 28 day ban!
 


I wouldnt lose sleep over it Tommy, my brother and good friend were both caught last year doing similar proportional speeds and they both got an SP50 ban of 28 days. In both cases it pushed their insurance up by around £80-£100 per year. Consider the fact your motor will be burning cash (20-30x) far quicker in depreciation!!!

If I were you mate, id just admit you were driving it, fill the form in send it back and see what they offer you. You might be lucky you might not but i doubt your gonna get away with it if you fight them.

Have you already got points coz if its your first offence they may be lighter on you.... I got done doing 85 in a 60 earlier this year, (i know its not quite so bad!) i just accepted it, got 3 points and £60 fine. I reckon youll get 6 points and a slightly bigger fine but its difficult to tell what theyll be like...
 


if your lookin at just a fine then pay up

if its a ban then look for ways of gettin out of it



im sure a couple of these fellas are lookin into possible solutions for ya now

the camera/gun caliberation certificate is a possible one

Cheers Cap, already been to this website amongst others. These figures are 11 months old and are only guidlines. Not bothered about the fine, its the points/ban that concerns me.

its dodgy due to the speed and the 50 mph limit.

If the car was in the dealership no doubt you paid by credit card or the likes and have a receipt for the work done? if so then you can use this to your defence along with the fact that if your car is in for work it has to be in early(ish) so if the incident was say at 2pm and you didnt collect your car till say 5pm and the work done was 4 hours of labour then this would prove you to be innocent (but it will be hard for the court to then prove who was driving your car whilst in the care of said Renault dealer) so you should get away with it, but you will need to get as much info as you can (receipts, credit card bill etc) to back this up.

WHAT IS THIS COUNTRY COMING TO ?

Ive just answered the door to a Policeman with a warrant for my arrest!

My court case was the 4th of Decmber, I spoke to a solicitor, sent in my driving license as requested. Was just about to write to them asking what the hell was going on and this happens.

Turns out that I was due to appear in person on the 18th of December. Only problem........ they didnt tell me!

Im off to Canada!
