Where do I stand with this? (So f**ked off) Advice needed!

Basically I bought a 13inch Macbook off eBay advertised as like brand new with light usage 12 months old

Paid £600 for it Duo core, 4GB RAM, 120GB HDD received it on Tuesday morning. Didn’t open it while I got home from work about 5 ish as I was working all day.

When I did open it the Macbook Box was tatty and shabby to say the least with all the cardboard peeling and tattered. The Macbook itself was covered in scratches top and bottom all over it, there was a small scratch on the screen, dirt under the keyboard, the caps lock was dodgy and to top it off the CD/DVD drive was faulty. The Macbook was also covered in brown stains and the charger was no longer the beautiful Apple white it was coffee brown and covered in what appeared to be blue or green ink.

Bearing in mind the laptop was advertised as being lightly used it looked like it had gone 3 rounds with Prince Naseem Ahmed. The seller is called AppleCore_TheSpecialists and up to this point had been magnificent in replying quick and fast delivery etc it was a massive shame about the goods. He was aa Apple power seller and had 100% 5 star feedback.

I emailed the seller and he said the CD drive was working priory to dispatch as he had reinstalled it with Snow leopard on the 5th May although upon looking in the Logs there were logs as far back as 2009 so he was blatantly lying, he left me no choice but to log a eBay dispute.

More comments: The seller said he had used Cds in it prior to delivery to reinstall the macbook but this clearly isnt the case as their is logs on the macbook going as far back as 2009 which shows the seller is lying as if the macbook had been reinstalled when he originally said, i.e a few days prior to delivery it wouldnt have logs on from 6-12 months ago. The Cd drive will not work at all!

"Bought this new Macbook which I received today it is covered in scratches which this wasnt in the description the seller also told me it looked brand new. Their is brown stains on some of the white plastic of the macbook also. 3rd thing and most important thing wrong with the macbook is the CD drive doesnt work, it will not take any cds what so ever. I;m not happy about having to send it back as its going to have to go special delivery and going to cost a fortune."

"I have decided I want a full refund and to return the item immediatley! I also want feunding for any postage it is going to cost me! Problems with the Macbook: 1. CD/DVD drive is faulty 2. It is over in scratches and brown staines 3. There is a scratch on the glossy screen of the Macbook 4. The charger is tatty and shabby and is covered in what appears to be blue or green ink! I was told this laptop is a refurbished laptop as brand new and has had light use and 12 months old. This is clearly not the case. I am a Systems Networking Manager by trade, IT support is my job and i'm not going to be fobbed off! This laptop looks like it has had heavy duty use and been thrown around quite alot!"

I have posted the item (12/05/2010) special deliery so will be with you tommorow(13/05/2010) before 1pm. It cost me £21.65 to post it I want this refunding also aswell as the £599 making it a total of £620. I feel you have wasted alot of my time and has cost me quite a bit in petrol to my nearest royal mail post office! You obviously new the CD drive wasnt working as the laptop has logs on it as far back as 2009. If you don't refund the full ammount including postage I will be seeking advice from my solicitor I have everything that has happened in writing with photographic and video evidence of the faults with the laptop. If you refund the full ammount £620 I will leave you positive feedback. Please refund me the full ammount as soon as possible as I now need to waste another week trying to find another Mac! Regards

He signed for the laptop this morning at half past 10 and he hasn’t responded since, baring in mind it was taking him 5 minutes to reply before. I phoned ebay and they say i have to wait 10 days for him to reply!
I’m so upset no macbook and £650 out of pocket!
Anyone got any advice? I have his full name and address, could I go to the police?

you have to wait, but you should be covered by paypal anyway, don't stresst about it, it'll workout fine.

Only thing is I demanded he also refund me the £21 postage it cost me to post it special delivery back to hime!

Do I keep on demanding it? As it wasnt my fault he falsely advertised it, also wondering whether to leave him negative feedback?

Just leave him the feedback and dont bother buying from him again. As for the pstage i'd leave that too. You dont normally get refunds on postage (i think?)

cut your losses m8, never buy something second hand over the net that is expensive, there are to many idiots trying to make a quick buck, although it gives other sellers a bad name, but at least it cant happen to you again:approve:

Wait for some feedback before you wade in threatening him... never threaten with NF.

It's a shame, I see what people are saying about over reactive but tbh I would be the same, especially after spending that kind of money on something described as mint. Wait for the reply!

Also, just noticed there only 5 minutes away from me, Ha, might pop round to them and get a bargain to clean up lol.
