My Cup, and why I’m p1ssed off...





It turns out that my brand new Cup was extensively re-sprayed prior to delivery (three months ago) in the following places:


Both doors
Roof
Bonnet
Nearside rear quarter panel
Front bumper
In addition:


Rear bumper paint coat is too light
Boot lid is rusting
Rear wheel arches have primer showing
Cup badges on doors are hanging off
Renault UK cant seem to tell me why or where the repairs were done and that they are perfectly entitled to repair cars prior to delivery to customers. They also claim that they are not obliged to tell them of any work done. They want to look at the car though before taking any action, but I spoke to them early last week and they havent yet made arrangements to view it.

Tomorrow I am seeing a solicitor who specialises in consumer law/litigation. I will be looking to reject the car and get out of my finance agreement.

Im certain they cant, and wont, get away with deceiving me like this :mad:

Im sure once you threaten them with legal action theyll soon change their tune...

Might be worth threathening them with going on Watchdog!



Would be sooooo p!ssed off if this were mine.

This happened to me with an Astra (company car). I was promised delivery on a particular day, then a couple of hours before my car was due to arrive I got a phone call to say it would be another week. Turned out the lad who was delivering it had tried to break the land-speed record and had piled it into a ditch.

They repaired it and delivered it! I moaned but apparently its normal practice. As the guy said to me on the phone - what do you expect us to do with it, throw it away?.

Amazing but true. Not nice if its your car though.
 


Watchdog have been informed, if theyre interested they will be in touch with me in the near future.

Im keen to find out from the solicitor exactly what constitutes a new car. In my opinion its a factory fresh vehicle, except for any repairs agreed with the customer beforehand. As my fiancee describes it, my car is a second and should have been sold accordingly.

Will let you all know how I get on if youre interested?

I dont expect them to throw it away, but they should discount it and sell it as a used vehicle (priced accordingly). As a company car I dont suppose it matters as it would be auctioned off at the end of the lease period.

My argument is that if I were to trade it/sell it tomorrow and an inspection was done on the car (likely, with it being a performance model) then my re-sale value will be less due the re-spray. This is Renaults fault, not mine, and I shouldnt have to pay for it.
 


Forget threatening with Watchdog, it doesnt work. Theyll hear it all the time. Just tell them that you are intesnding to inform trading standards, then immediately make your complaint to Trading Standards via their web site. Theyll be in contact with both parties in less than a week.

Every time Ive used them, Ive got what I wanted (within reason of course). Id be arguing that the goods arent in a fit condition and not as described.

Just noticed you have the car on finance. That means it is covered under the Consumer Credit Act and the finance company are as responsible for the condition of the car as the dealership are. Youre in a pretty strong position.

I agree - its got to be perfect. Often a respray can be better than the original paintwork if its done properly. Pity they didnt take more care it sounds like it would have saved them a lot of hassle.

funny you should say that, I had mine into reno today about a mechanical problem, also I told them there was some paint missing from the inside of the passanger door. When I looked on the service sheet it said they had removed some masking tape from the car!

Theres also a pretty bad paint defect on the drivers side which Ive been advised I have to go to reno in leeds to have looked at.

PS on the legal front I would think that they will have an obligation to put everything right but doubt you will get them to swap it. They could probably argue that the spray work was tidying up the cosmetics prior to delivery. The chap I spoke to at reno says that they get damaged on transporters all the time.
 


Was going to say about the transporters too. A mate of mine makes a fortune as a glass replacer (a La AutoGlass etc) ans spends most of his time at main barnd dealers replacing smashed glass where cars have been dropped off the transporter etc.



Another mate had a summer job working for Rover on an old abandoned airfield, basically, they stored new cars on the airfield, and when a transporter came in to load up, they would tear off round the airfield in a big gang (one dropping the rest off) until they all had a brand new car, then they would all race back to the transporter, the winner gaining a fiver from all the rest!!! Needless to say some cars got a few prangs, but they still went onto the transporter anyway!!

i have said it before but years back my old boy bought a brand new megane, after he got it his mate who is a bodyshop owner noticed that the drivers side wing and drivers door was a slightly different colour, so car went in to be inspected, found it was different colour, non renault parts used, replacement bolts rusting, masking tape still in place, old boy contacted dealer who denied anything wrong with car, they inspected it and refused to say anything was wrong with car, so after threatening to take out the sales manager they admitted they had crashed car taking it from the transporter into the garage!
 


Well the solicitor thinks I have a very strong case and that I wont lose :)

In order to get a quick resolution, Im going for a replacement Clio Cup from the dealer but with Climate Control added as compensation (I dont have climate at the moment).

My Magnex cat-back and Green filter have been removed and the car is being dumped at the dealers tomorrow. Finance payments have been cancelled and the solicitors letters will be in the post soon.

Cant wait to see the General Managers face tomorrow when I hand him the keys to the car...
 


^^thats apauling^^ after i had an acident in my 5 day old clio, i took it to 2 independat specialists and had records taken about the tire wheel (as the tire cam off as conering du to being underinflated!!!) in case renault decided to loose the wheels ect. We made it clear that we would take legal action, when they came back and said they would meet us half way, my mother, who happens to be a lawyer said to them if thats ther best offer then they will be facing legal action, they quickly decided that out of a good will gesture they would pay for the repairs!!

I check the other tires - one of them was filled to 27 psi rather than 2.7bar or the other way around, which every is lower (with the correct figure 27 is just a stab in the dark)

At the end of the day, of course they are going to try there luck as some people may just say OK and walk away, but as soon as they hear of a legal suit its not worth the legal fees as well as time taken up of the renault dealer empoyees or even the bad press
